Amar Singh Chamkila – directed by Imtiaz Ali and starring Diljit Dosanjh and Parineeti Chopra in lead roles, released on Netflix earlier today. However, prior to its release, the biographical drama – based on the life of the Punjabi musician who was also known as Elvis of Punjab and his partner Amarjot Kaur, was in the news as a motion to delay its release was filed.
As per the latest update, the film has released on Netflix with no trouble as a Ludhiana court has refused to grant an order to stay it. As per the report, the court declined to grant an injunction as the plaintiff’s claims did not amount to copyright infringement.
Court declines to grant injunction
As reported by Hindustan Times, the court of Additional District Judge Shatin Goyal in Ludhiana, in an order pronounced late on Wednesday, refused to pass any injunction orders on the telecast of Amar Singh Chamkila on Netflix. The next date of the hearing is May 6.
Advocate Siddharth Sharma Tejas, who along with Advocate Ravinder Kumar Sharma, is the counsel for Window Seat Films and Reliance Entertainment, said, “Refusing to pass any injunction orders on the film’s release, the court has adjourned the application and has granted due time to the filmmakers to file their written response.”
Tejas added, “We argued that the movie’s release cannot be injuncted as the matter does not amount to any copyright infringement and the agreement on which the plaintiff is relying is barred by law of limitation and provisions of Copyright Act. The order refusing the injunction was pronounced in the open court. The court said ‘No injunction, no urgency.’”
Perpetual injunction on Amar Singh Chamkila
On April 8, Patiala-based Ishdeep Singh Randhawa filed a petition demanding “perpetual injunction” and “restrain on the release of the film”. In his plea, Randhwa claimed that Chamkila’s first wife, Gurmail Kaur, had sold exclusive rights to the biopic to his late father Gurdev Singh. He added that his father acquired the rights through a formal agreement on October 12, 2012, and even gave Kaur had taken Rs 5 lakh for the same. He stated that as his father’s legal heir – Gurdev Singh passed away in November 2022, the rights to make the film on Chamkila’s life were with him and his family. Randhawa had filed a similar lawsuit in a Ludhiana court last year but withdrew from it later.
