On Tuesday, a Special NDPS court granted bail to two co-accused in the cruise ship drug case. Shah Rukh Khan’s son Aryan Khan has also been in the Arthur Road Jail along with the other accused in relation to the case. Manish Rajgaria and Avin Sahu became the first accused to get bail in the cruise ship drug case.
NCB had claimed that Rajgaria and Sahu were among the guests on the cruise. NCB had taken in as many as 20 people including Aryan Khan. Meanwhile, Aryan was denied bail by the Special NDPS Court after which his lawyers had moved to the Bombay High Court.
In today’s hearing, Aryan Khan’s lawyer Mukul Rohatgi said in Court, “My case will go to 8(c), 27 and 20(b) and not Section 27A. My case is far from Section 27A. Out of the twin conditions for bail, Section 37 does not apply because 27A has no application. Section 64A has immunity from prosecution if you are prosecuted under Sec 27 and you go to rehab. I am arguing a case that is actually not there against me. My case is not of possession or consumption. In the US and some parts of the world, cannabis is legal. With this compendium of facts, what I am saying is that there is no case. There is no consumption, no possession… Why this boy has been sent 20 days in jail.”

Aryan’s lawyer also said on Khan’s behalf, that Aryan has nothing against any NCB officer or any connection with the allegations of a payoff involving Sameer Wankhede.
Aryan’s bail hearing will now continue tomorrow at 2:30 pm.
