The Bombay High Court has rejected businessman and actor Shilpa Shetty’s husband Raj Kundra and Ryan Thorpe’s bail applications which challenged the magistrate court’s remand order hence seeking immediate release from judicial custody. Currently, Raj Kundra and his associate Ryan are in judicial custody in relation to the pornography case.
Presided over by Justice A S Gadkar a single bench has rejected Raj and Ryan’s bail application as they said that their custody was within the conformity of law and did not require interference. Shilpa Shetty’s husband, Kundra and his associate had termed their arrest illegal in their petition as the mandatory provision of issuing notice under section 41A of the Code of Criminal Procedure (CrPC) was not followed.

Earlier, the court in order as per IANS said that the alleged offence is also detrimental to the health of our society, “One of the considerations for refusing or granting the bail is the nature of offence and gravity of the offence. The effect of the alleged offence is having nexus with the public at large. The alleged offence is also detrimental to the health of our society.” Further, the court said rejecting the bail applications, “In such circumstances, societal interest in the prosecution of a crime that has a wider social dimension cannot be overlooked. At present investigation is in progress. In such circumstances, at this stage release of the accused will definitely hamper the investigation. So considering the facts and circumstances, both the bail applications are rejected.”
Meanwhile, Sherlyn Chopra recently recorded her statement in relation to the Raj Kundra case. The diva told the media that the police asked her about her relationship with Raj Kundra and the videos that she shot. Chopra said that she wants justice for the victims.
