Ram Gopal Varma has been found guilty under Section 138 of the Negotiable Instruments Act, which penalizes cheque dishonour due to insufficient funds or surpassing the account’s limit. In addition to a three-month jail term, he has been directed to pay Rs 3.75 lakh as compensation to the complainant. On June 1, 2018, the complainant deposited a cheque issued by Ram Gopal Varma to clear the dues, but it was returned due to “insufficient funds.” When the complainant approached Varma again, he was given another cheque, which also bounced, this time with the remark “payment stopped by drawer.” This led to the complainant filing a criminal case in the Andheri Magistrate Court.
Varma contested the allegations, claiming that the cheques neither bore his signature nor were issued by him. However, the magistrate dismissed his defense, citing a lack of substantial evidence to support his claim. Varma took to twitter and write, “With regard to the news about me and Andheri court, I want to clarify that it is to do with a 7 year old case of Rs 2 lakh 38 thousand amount , relating to my ex-employee .. My advocates are attending to it. and since the matter is in court I cannot say anything further.”
The case dates back to 2018, when a firm named Shree, represented by partner Mahesh Chandra Mishra, filed a complaint. According to the firm’s lawyers, Rajesh Kumar Patel and Alok Singh, Shree has been supplying hard disks for years. Between February and March 2018, the company provided hard disks to Ram Gopal Varma’s firm, for which they raised a bill of Rs 2,38,220.
A Vile Parle based company filed a check bounce case, and the Andheri Metropolitan Magistrate’s Court ruled Ram Gopal Varma’s organization guilty last month. He challenged the order in an appeal that was filed earlier this month at the sessions court. His attorney asked for bail and a sentence suspension during Thursday’s hearing. The complainant has received a notification from the sessions court judge, who has set a hearing date for next month.
